Terms of Service

Welcome to AutoNova Finance. These Terms of Service ("Terms") are a legal agreement between you and AutoNova Finance ("AutoNova Finance", "we", "us", or "our"), based in Calgary, Alberta, Canada. They govern your use of the website autonovafinance.ca, our online pre-approval application, and any related services we offer (together, the "Service").

Please read these Terms carefully. By using the Service or submitting our pre-approval form, you confirm that you have read, understood, and agreed to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

1. Who can use the Service

You may use the Service only if you:

• Are at least the age of majority in your province (18 in Alberta);
• Are a resident of Canada;
• Have the legal capacity to enter into a binding contract and into a vehicle financing agreement; and
• Are using the Service for your own personal, non-commercial purposes.

The Service is intended primarily for Alberta residents. If you apply from outside Alberta, we may not be able to help you, and we may refer you to a partner in your province or decline the application.

2. What AutoNova Finance is (and is not)

AutoNova Finance is a lead-generation and pre-approval matching service. We are not a lender or a dealership ourselves. We work with a network of Canadian lenders and Alberta dealer partners to help connect Alberta drivers with vehicles and financing options, including drivers with bad credit, no credit, new Canadians, and people who have gone through bankruptcy or a consumer proposal.

We are not:

• A bank, credit union, or licensed lender;
• A mortgage broker or financial advisor;
• A credit counselling or debt-relief service; or
• A credit reporting agency.

Any financing you are offered will come from a third-party lender. The final loan terms, interest rate, down payment, approval, and vehicle availability are set by that lender and by the dealership, not by our website, and will be documented in a separate written agreement that you will have the opportunity to review before signing.

3. The pre-approval form and your credit

Our pre-approval form is a soft pre-qualification based on the information you type in. Submitting the form does not affect your credit score and does not result in a hard inquiry on your credit report. We do not pull your credit report from Equifax, TransUnion, or any other credit bureau when you submit the form.

A formal credit application, which may involve a hard credit inquiry, will only happen later, with a separate, clearly-labelled credit authorization that you sign at the dealership or through a secure electronic form. You are free to stop the process at any time before you sign that credit authorization.

You agree to provide information that is true, accurate, current, and complete. Submitting false or misleading information may result in your application being declined, your account being terminated, and, in serious cases, referral to the appropriate authorities.

4. Consent to be contacted

By submitting our pre-approval form, you expressly consent to be contacted by AutoNova Finance and our sales team by telephone, text message (SMS), and email, using the contact information you provide, about your application, our inventory, appointments, and related offers. You understand that:

• We may contact you quickly after you submit the form (often within a few minutes);
• Standard message and data rates from your mobile carrier may apply to text messages;
• You may withdraw your consent to marketing communications at any time by replying STOP to any text, clicking the unsubscribe link in any marketing email, or emailing info@autonovafinance.ca; and
• Even after you unsubscribe from marketing messages, we may still contact you about an active application or transaction.

5. Acceptable use

When you use the Service, you agree not to:

• Submit false, misleading, or stolen personal or financial information;
• Submit an application on behalf of someone else without their written permission;
• Use the Service for any unlawful purpose, including fraud, identity theft, or money laundering;
• Attempt to access, probe, or test the vulnerability of our systems, or bypass any security or authentication measures;
• Scrape, crawl, copy, cache, data-mine, or otherwise reproduce any part of the Service without our written permission;
• Interfere with or disrupt the Service, its servers, or the experience of other users;
• Use the Service to send spam, malware, or other harmful code; or
• Use any automated tool, bot, or script to interact with the Service.

We reserve the right to refuse, suspend, or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms.

6. Phone verification

As part of the application, we verify your phone number by sending you a one-time code via SMS using a third-party service (Twilio). By entering your phone number, you represent that it belongs to you and that you are authorized to receive text messages on that number. Carrier charges may apply.

7. Vehicles, pricing, and financing disclosures

Any vehicle descriptions, prices, payment examples, interest rates, or financing terms shown on our website are for general information only and are subject to change without notice. Vehicle availability is not guaranteed. Photos may not represent the exact vehicle you would purchase.

In accordance with Alberta's Automotive Business Regulation, any advertised vehicle price is intended to be an all-in price that includes the cost of the vehicle, accessories, optional equipment physically attached to the vehicle, transportation, and any administration fees and applicable taxes, but excluding GST and costs and charges associated with financing. Additional costs such as financing charges, GST, and optional products selected by you will be disclosed separately before you sign any agreement.

If any payment example, interest rate, or financing term is shown, the actual rate and amount you are offered depends on your credit, your down payment, the lender, the vehicle, and other factors, and will be disclosed in accordance with Alberta's Cost of Credit Disclosure Regulation before you sign a financing agreement.

AutoNova Finance and its affiliated dealership operate in Alberta and are regulated by the Alberta Motor Vehicle Industry Council (AMVIC).

8. Intellectual property

All content on autonovafinance.ca, including text, graphics, logos, images, icons, page layouts, code, and software, is owned by or licensed to AutoNova Finance and is protected by Canadian and international copyright, trademark, and other intellectual property laws.

You are granted a limited, personal, non-exclusive, non-transferable, revocable licence to access and view the Service for your own personal, non-commercial use. You may not copy, modify, distribute, sell, lease, or create derivative works of any part of the Service without our prior written permission.

"AutoNova Finance" and the AutoNova Finance logo are trademarks of AutoNova Finance. Other trademarks shown on the site belong to their respective owners.

9. Third-party websites and content

Our website may contain links to third-party websites, including lenders, manufacturers, and partner dealerships. These links are provided for convenience only. AutoNova Finance does not control, endorse, or take responsibility for the content, privacy practices, or terms of any third-party website. Your use of those sites is at your own risk and subject to their own terms and policies.

10. No advice

The information on autonovafinance.ca is provided for general informational purposes only. It is not legal, financial, tax, credit, or professional advice, and should not be relied upon as a substitute for advice from a qualified professional. You are responsible for deciding whether any financing or vehicle offer is right for your situation.

11. Disclaimers

To the fullest extent permitted by law, the Service is provided on an "as is" and "as available" basis, with all faults and without warranties of any kind, whether express, implied, or statutory. AutoNova Finance specifically disclaims all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free;
• The information on the site is complete, accurate, or up to date;
• Any particular vehicle, lender, interest rate, or approval will be available to you; or
• Any defects in the Service will be corrected.

Nothing in these Terms limits or excludes any rights you may have under Alberta's Consumer Protection Act or other mandatory consumer protection laws that cannot be waived by contract.

12. Limitation of liability

To the fullest extent permitted by applicable law, AutoNova Finance, its parent dealership, and their officers, directors, employees, agents, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or in connection with your use of, or inability to use, the Service, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, the total aggregate liability of AutoNova Finance for any and all claims arising out of or related to the Service is limited to one hundred Canadian dollars (CA$100).

This section does not limit liability for anything that cannot be excluded or limited under applicable Alberta or Canadian law, such as fraud, gross negligence, or mandatory consumer protection rights.

13. Indemnity

You agree to defend, indemnify, and hold harmless AutoNova Finance and its parent dealership, affiliates, and their respective officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or connected with:

• Your use of the Service;
• Your violation of these Terms;
• Any information you submit through the pre-approval form that is false, inaccurate, or fraudulent; or
• Your violation of any law or the rights of a third party.

14. Changes to the Service and to these Terms

We may, at any time and without notice, change, suspend, or discontinue any part of the Service, add new features, or impose limits on certain features or areas.

We may also update these Terms from time to time. When we do, we will update the "Effective date" at the top of this page. If the changes are significant, we will take reasonable steps to notify you, for example by posting a notice on our homepage. Your continued use of the Service after the updated Terms are posted means you accept the changes.

15. Termination

We may suspend or terminate your access to the Service at any time, for any reason, including if we believe you have violated these Terms. You may stop using the Service at any time. Sections of these Terms that by their nature should survive termination (including sections on intellectual property, disclaimers, limitation of liability, indemnity, and governing law) will continue to apply after termination.

16. Governing law and jurisdiction

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply in Alberta, without regard to conflict-of-laws rules.

You agree that any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the courts located in Calgary, Alberta, and you consent to the personal jurisdiction of those courts. Nothing in this section prevents either party from seeking urgent injunctive or equitable relief in any court of competent jurisdiction.

17. General

• Entire agreement. These Terms, together with our Privacy Policy and any consents you give during the application process, form the entire agreement between you and AutoNova Finance regarding the Service.
• Severability. If any part of these Terms is found to be invalid or unenforceable, the rest will continue in full force and effect.
• No waiver. If we do not enforce a provision of these Terms, that does not mean we have waived our right to enforce it later.
• Assignment. You may not assign or transfer these Terms without our written permission. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
